Welcome to LoKo.

These Terms & Conditions (“Terms”) govern your access to and use of the LoKo mobile application, website, content, products and services (collectively, the “Platform”) operated by LoKo (“LoKo”, “we”, “our” or “us”).

By accessing or using LoKo, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.

Eligibility

You must be at least 13 years old to use LoKo.

By using the Platform, you represent and warrant that:

you are legally capable of entering into binding agreements;
the information you provide is accurate;
and you will comply with these Terms and all applicable laws.

User Accounts

To access certain features, users may be required to create an account.

You are responsible for:

maintaining the confidentiality of your login credentials;
all activity conducted under your account;
and ensuring your account information remains accurate and up to date.

LoKo reserves the right to suspend or terminate accounts that violate these Terms or engage in suspicious, abusive or unlawful behaviour.

Platform Purpose

LoKo is a discovery platform designed to help users explore local businesses, events, activities and experiences.

LoKo may provide:

personalized recommendations;
location-based discovery;
saved collections;
business profiles;
event listings;
maps and navigation tools;
and future social or interactive features.

LoKo does not guarantee the availability, quality, accuracy or legality of any third-party business, event or listing displayed on the Platform.

User Content

Users may upload, submit or publish content including:

photographs;
business information;
event details;
profile information;
comments;
and other materials (“User Content”).

You retain ownership of your User Content.

By submitting User Content, you grant LoKo a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, modify and distribute the content for purposes related to operating, promoting and
improving the Platform.

You agree not to upload content that:

is unlawful, misleading or deceptive;
infringes intellectual property rights;
contains harmful or offensive material;
violates privacy rights;
or breaches applicable laws.

LoKo reserves the right to remove User Content at its discretion.

Business Listings & User Submissions

Businesses, events and listings displayed on LoKo may be:

user submitted;
business submitted;
automatically sourced;
or curated by LoKo.

LoKo does not independently verify all listings and makes no guarantees regarding:

accuracy;
availability;
pricing;
operating hours;
or user experiences.

Users should independently confirm relevant details before attending or purchasing from any third party.

Location Services

Certain features of LoKo rely on location data.

By enabling location permissions, you consent to LoKo using location information to:

personalize content;
show nearby places and events;
improve recommendations;
and support platform functionality.

Location permissions may be disabled through device settings, however some features may become unavailable.

Payments & Subscriptions

Certain features or services may require payment, subscription fees or promotional purchases.

Payments may be processed through third-party providers including Stripe.

LoKo reserves the right to:

change pricing;
introduce new paid features;
modify subscription structures;
or discontinue services at any time.

Unless required by law, payments are non-refundable.

Intellectual Property

All Platform content excluding User Content, including:

logos;
branding;
software;
graphics;
design elements;
text;
and Platform functionality

is owned or licensed by LoKo and protected by applicable intellectual property laws.

Users must not:

copy;
reproduce;
modify;
distribute;
reverse engineer;
or commercially exploit Platform content without prior written consent.

Prohibited Conduct

Users must not:

use LoKo unlawfully;
interfere with Platform functionality;
attempt unauthorized access;
scrape or harvest data;
upload malicious software;
impersonate others;
post misleading or fraudulent content;
or engage in abusive behaviour.

LoKo reserves the right to investigate and take action against prohibited conduct.

Third-Party Services & Links

LoKo may contain links, integrations or services provided by third parties.

LoKo is not responsible for:

third-party websites;
external services;
payment providers;
maps;
or third-party content.

Use of third-party services may be subject to separate terms and privacy policies.

Disclaimer

LoKo provides the Platform on an “as is” and “as available” basis.

To the maximum extent permitted by law, LoKo disclaims all warranties, representations and guarantees regarding:

reliability;
accuracy;
availability;
suitability;
or uninterrupted operation.

LoKo does not guarantee:

that listings are accurate;
that businesses will honour promotions;
or that users will achieve any particular results from using the Platform.

Limitation of Liability

To the maximum extent permitted by law, LoKo will not be liable for:

indirect or consequential loss;
loss of profits;
loss of revenue;
loss of data;
reputational damage;
business interruption;
or damages arising from use of the Platform.

Where liability cannot be excluded under Australian Consumer Law, LoKo’s liability is limited to the minimum extent permitted by law.

Indemnity

You agree to indemnify and hold harmless LoKo, its affiliates, directors, employees, contractors and partners from claims, damages, liabilities and expenses arising from:

your use of the Platform;
your User Content;
your breach of these Terms;
or your violation of applicable laws or third-party rights.

Suspension & Termination

LoKo may suspend, restrict or terminate access to the Platform at any time where:

these Terms are breached;
unlawful activity is suspected;
or Platform integrity or safety is at risk

Users may discontinue use of LoKo at any time.

Privacy

Use of LoKo is also governed by the Privacy Policy.

By using the Platform, you acknowledge that personal information may be collected, used and disclosed in accordance with the Privacy Policy.

Changes to These Terms

LoKo may update these Terms from time to time.

Updated versions will be published through the Platform together with a revised effective date.

Continued use of LoKo after updates are published may constitute acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any disputes arising in connection with these Terms or the Platform will be subject to the non-exclusive jurisdiction of the courts of Queensland.
